It is general knowledge that law is a complex discipline to understand and master without several years of studies and practice. This results in contracts being blindly signed without being read, let alone understood and without even knowing it, parties take involuntary risks such as breaching their contractual obligations or clauses of the contract. In this regard, legal design aims to get rid of these “bad practices” and ensure legal safety. Our goal is to create legal contents that users want to read and actually understand. Making legal obligations clear and easy to understand lies at the heart of Legal Design. Several legal sources, such as GDPR, indeed require more clarity of legal content and aim to get rid of legal jargon. Article 12 GDPR states : “Any information relating to processing to the data subject must be provided in a concise, transparent, intelligible and easily accessible form, using clear and plain language”.
Thus the goal of Legal Design is to better inform and guide the general public through legal regulations.
Legal design can take various forms : an app, a website, a redesign contract or even an engaging legal training. For instance, a contract can be designed to be consulted on a mobile phone or on a desktop. Instead of a thirty-pages word document, users can access legal content in a different way. One of the advantages is that design techniques can allow us to highlight important elements and obtain a valid consent from users.
Several legal practitioners have issues to ensure compliance programs are understood and applied. For investment funds, this lack of clarity can even amount to loosing deals. This is where legal design’s added value really strikes – by creating compliance program based on real scenarios and giving users tool to actually apply legal recommendations in real life.
Lengthy contracts can be as long as dozens of pages and are largely misunderstood by the general public. Both content and format are inaccessible and few people actually read the entire content before signing. In this context, legal design’s role is to shape the form of the law to make it more clear. Legal Design is crucial when it comes to presenting legal information. For instance, private equity funds have contacted us to clarify their investment policies. This allowed investors to fully understand the legal requirements and how this would impact their decision.
As of today, companies must enforce GDPR in France but more generally all over the European Union. However, data protection policies more often than not remain unclear to users. This was at the heart of the Moët Hennessy project. In this context, we used legal design to ensure users had better access to information.
Legal design can also help prevent litigation. For instance, in negotiation, difficult legal issues can arise. In this context, it is necessary to have access to the right legal information at the right time. One of our clients faced exactly this situations, where business teams had several legal questions before important client meetings and would call the legal department on their way, from their car, to get the right information. This situation was far from ideal. In this context, our team created an online document, enabling them to easily access legal information from their mobile or tablet.
In all our project, we apply the legal design user centric methodology. Indeed, the main purpose of this field is to create a satisfying user experience of the law. To ensure this, we apply a precise and detailed methodology that stems from design principles. At Amurabi, we use this method throughout all our work. For each project we define a user profile and a user journey to develop empathy – meaning in this case how can we best address its needs.
