Empowering business teams to understand and negotiate their contractual liability
Contractual responsibility might be a founding stone of the law, but is not so simply applied in practice. In a very decentralized group, how do you raise business teams’ awareness of the importance of the issue, and root the right habits in terms of contract negotiation?
The challenge was to engage project managers with little legal knowledge, as well as business units’ CEOs, and enable them to understand the potential legal risks and how to mitigate them.
Apply our user-centric methodology, we facilitated a user workshop with engineers from diverse backgrounds and experience level to understand their journey into contract-negotiation. Always on the field, our users felt that they needed a document they could consult from anywhere as opposed to a static document. They also felt the need for ready-made legal arguments to know how to negotiate this sensitive topic with other parties.
Thanks to a user workshop, we dived into the business owners’ universe: a world in which a specific business jargon is used, where technical excellence rule, where financial stakes of large projects can reach hundreds of millions.
We leveraged all these insights to entirely redraft the guide, in a business-style language while keeping the same meaning.
We instilled the right information as to liability at the right time, linking it directly to what matters most to business owners: project’s profitability while ensuring safety.
We created a negotiation toolkit to ensure they could be autonomous on the ground when negotiating liability issues, with golden clauses and NoGo’s. The graphic design was directly inspired by the industry to engage readers without being cliché
During the testing workshop, we applied the methodology of our User Lab, which allowed us to measure the impact of the new guide: collecting scores of 4.8 out of 5 for commitment and 4.6 out of 5 for the perceived usefulness of the document. The comprehensibility of the document received a score of 91% (Cloze Test result out of 11 participants).
